Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Guardian Brief LLC ("GuardianBrief," "we," "us," or "our"), a Pennsylvania limited liability company. By accessing or using guardianbrief.com and any associated services (collectively, the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

GuardianBrief provides AI-powered tools designed to help families protect aging adults from scams, fraud, and social engineering. The Service includes, but is not limited to:

  • Suspicious message and phone call evaluations
  • Family code word generation
  • Monthly personalized scam briefings
  • Conversation script generation
  • Shareable briefing links
  • Parent profile customization

The Service is intended for informational and protective purposes only. It does not constitute legal, financial, or professional advice.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

4. Account Registration

To access most features, you must create an account by providing a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@guardianbrief.com if you suspect unauthorized use of your account. We reserve the right to terminate accounts at our discretion.

5. Subscription and Billing

Access to GuardianBrief Pro features requires a paid subscription at $9.99 per month. Subscriptions are billed monthly and automatically renew until canceled. All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

You may cancel your subscription at any time through the billing portal in your account settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods except as required by applicable law.

We reserve the right to change subscription pricing with at least 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Submit content that is harmful, abusive, threatening, defamatory, or fraudulent
  • Attempt to reverse-engineer, decompile, or tamper with the Service
  • Use automated tools, bots, or scripts to access or scrape the Service
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Share your account credentials with any third party
  • Use the Service to generate or distribute scam content

We reserve the right to suspend or terminate your account for violations of this section without notice.

7. AI-Generated Content

The Service uses artificial intelligence, including models provided by Anthropic, to generate evaluations, scripts, briefings, and recommendations. You acknowledge that:

  • AI-generated content may not always be accurate, complete, or up to date
  • Outputs should not be relied upon as the sole basis for decisions involving personal safety or finances
  • We do not guarantee that the Service will detect all scams or fraudulent communications

Always use your own judgment and consult appropriate professionals when making decisions about your family's safety and finances.

8. User Content

You may submit messages, screenshots, and other content ("User Content") to the Service for evaluation. By submitting User Content, you grant GuardianBrief a limited, non-exclusive license to process and analyze that content solely for the purpose of providing the Service to you. We do not use your User Content to train AI models.

You are solely responsible for the content you submit and represent that you have the right to submit it. Do not submit content containing sensitive personal or financial information beyond what is necessary for evaluation.

9. Intellectual Property

All content, features, designs, trademarks, and technology comprising the Service are the exclusive property of Guardian Brief LLC or its licensors. Nothing in these Terms grants you any right to use our trademarks, logos, or proprietary materials without our express written consent.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GUARDIAN BRIEF LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

13. Indemnification

You agree to indemnify, defend, and hold harmless Guardian Brief LLC and its affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Pennsylvania, and you consent to personal jurisdiction in such courts.

15. Changes to Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. If we make material changes, we will notify you by email or by a prominent notice within the Service. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

16. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service ceases immediately. Sections 7–14 of these Terms survive termination.
